[an error occurred while processing this directive] This story was sent my way about 3 weeks ago (May 2000).
After checking into the facts it appears this district attorney is doing his best to dodge his duty as a prosecutor.
There are a number of questions that have not been answered.

I have communicated with Roye Hunter and she has sent an account of her story. I believe her.

I have also read what Miller had to say to the Mauston Times. He is so busy trying to convince that paper of what a good citizen he is that he fails to acknowledge or admit he confessed to killing Roye Hunters cat. Evidence shows what occured on that day was in no way humane. In fact no animal lover would do such a thing under any circumstance. That leads me to believe he is simply trying to save his rear from a jail sentence.

Let your voices be heard don't let this man off scot free.

951.02 Mistreating animals. No person may treat any animal, whether belonging to the person or another, in a cruel manner. This section does not prohibit bona fide experiments carried on for scientific research or normal and accepted veterinary practices.

(1) Any person violating s. 951.02, 951.025, 951.03, 951.04, 951.05, 951.06, 951.07, 951.09, 951.10, 951.11, 951.13, 951.14 or 951.15 is subject to a Class C forfeiture. Any person who violates any of these provisions within 3 years after a humane officer issues an abatement order under s. 173.11 prohibiting the violation of that provision is subject to a Class A forfeiture. Any person who intentionally or negligently violates any of those sections is guilty of a Class A misdemeanor. Any person who intentionally violates s. 951.02, resulting in the mutilation, disfigurement or death of an animal, is guilty of a Class E felony. Any person who intentionally violates s. 951.02 or 951.06, knowing that the animal that is the victim is used by a law enforcement agency to perform agency functions or duties and causing injury to the animal, is guilty of a Class E felony.

BRIEF CASE HISTORY

August 14, 1999 James Miller shot and killed Blanca, Roye Hunter's little cat, in the trailer court where they all lived. Shortly after Miller admitted the killing to 2 neighbors and officer Littlejohn. District attorney Dennis Schuh was given the police report but refused to prosecute. At first he said there were no laws to protect feral cats in WI -- but could not prove this. He next began a campaign aimed at portraying the incident as a "cruel hoax." Then, he claimed he could not prosecute because the police investigation was still going on.

Blanca's shooting

The investigation has long since ended -- still Schuh refuses to prosecute. As for his "feral cat" reference -- Schuh refused to consider the facts that Blanca was wearing a bright yellow collar AND was well known to Miller as Miller had visited Ms. Hunter several times and knew her cat. Also, Blanca had no tail. i.e., There is no way Miller did not know this was his neighbors cat. Still, Schuh refused to prosecute or even acknowledge the cat belonged to someone.

Chicago attorney Neal Levin offered to try to convince Schuh to prosecute. SCHUH FINALLY DID PROMISE TO PROSECUTE, BUT ONLY AS A MISDEMEANOR AND NOT A FELONY. HE ALSO AGREED TO SEND A NEWS RELEASE TO THE LOCAL MEDIA BECAUSE THEY WERE PORTRAYING THE KILLER AS THE 'WRONGED' PERSON.

DA SCHUH LIES

However, Schuh lied. He finally ran out of excuses not to begin prosecution, and had to admit he had no intention of doing so. Schuh feels killing a cat is not a big deal. He has said people must come first (i.e., Miller should not be punished.) He told the owner that cats kill birds so "What does it matter if someone killed your cat." However, exactly WHY Schuh won't prosecute is a mystery.

Mr. Schuh has gone to a lot of trouble in trying to shift the focus of this case so that those who are demanding he act will shut up and go away. He has written several people trying to convince them this is all a hoax. He has cited two facts to "prove" this. 1. Many who wrote him said they thought the cat was killed within the city limits. Schuh makes a big deal of this in saying it isn't true. The cat was killed in a trailer court outside the city limits -- (so what?? ) 2. Many had stated the cat was beaten to death. Schuh makes a big deal of telling them this is not true, either and they should not believe ANYTHING they hear about the case. In other words, Schuh is trying to lead people to believe since some things they heard were incorrect -- everything is.

However, Schuh DOES NOT tell people that the vet who first examined Blanca SAID she was beaten to death. Only later did he realize the cat had been shot. NOT ONCE DOES SCHUH MENTION OR REFER TO THE FELONY COMMITTED OR SAY THAT HE INTENDS TO PROSECUTE THE ADMITTED KILLER.

WHAT NOW?

Dennis Schuh hates people to contact him on this case. Now, he thinks he has successfully beaten back the public outcry and will not have to prosecute Miller.

Please write or call Schuh and ask him why he refuses to do what he was elected to do -- prosecute people who commit a felony. Also, send a letter or a copy of the one you send Schuh, to the media -- they think this is all a joke -- that Miller is a hero and Ms.Hunter a kook for seeking justice for her cat. ALSO, contact the WI attorney general and ask that he prosecute Schuh for not doing his job.

Dennis Schuh must be made to realize that decent people everywhere will not stand for law enforcement officials who think killing an animal is a joke and contrary to what he believes, we will not go away until justice is served.

James Miller (The cat killer) sent his statement to the Mauston Times who sent a copy to Pet Pals (pet pals has since been closed because the owner died).

After reading Miller's statement I have a question.
Why did you kill Roye Hunters cat?
If you are the animal lover you claim to be something does not fit.

QUESTIONS:

Is the statement just an attempt to keep your rear out of jail?
Why is the district attorney refusing to prosecute a case when the law is clear he should be?
What other duties is this district attorney turning his back on and why?
Why would attorney Schuh prosecute a dog shooting and not the cat killing?
Does attorney Schuh have a special soft spot in his heart for Miller?
Should the citizens be calling for an investigation of a law enforcement officer who fails to do his duty?
If Schuh can not or will not do his job should he be removed from office?

These are all questions the citizens from this area need to be asking themselves and acting upon.
